Who Qualifies for Parole in Place?

Non-citizen priority workers qualify for the EB-1 category. Each occupational category has certain requirements that must be met:

To be eligible for the Parole in Place program, you must meet the following criteria:

  • Entered the U.S. without permission: The non-citizen spouse must have entered the country without authorization.
  • Marriage to a U.S. citizen: As of June 17, 2024, you must be legally married to a U.S. citizen.
  • Continuous presence in the U.S.: You must have lived in the United States for at least ten years as of June 17, 2024.
  • Criminal and immigration history: Additional requirements may apply based on your criminal and immigration history.

This program does not apply to:

  • Parents of U.S. citizens;
  • Spouses of permanent residents;
  • Individuals who have been in the U.S. for less than ten years as of June 17, 2024;
  • Those who were not married to a U.S. citizen by June 17, 2024;
  • Individuals who entered the U.S. with a visa, passport, or other entry documents

How Parole in Place Helps You

If granted Parole in Place, you will receive protection from deportation for three years and become eligible to apply for a work permit. This status allows you to apply for a green card through your U.S. citizen spouse without the need to leave the country for consular processing. Additionally, stepchildren of U.S. citizens who are eligible for PIP can also benefit, ensuring that families can stay together in the United States.

Preparing for Your Parole in Place Application

To prepare for your Parole in Place (PIP) application, we recommend gathering the following documentation:
  • Proof of Marriage: Obtain your marriage certificate to confirm a legally valid marriage to a U.S. citizen as of June 17, 2024.
  • Identity Verification: Prepare proof of identity, which may include a valid driver’s license, state or country ID, birth certificate with photo ID, or a valid passport.
  • Proof of U.S. Citizenship: Gather documentation proving your spouse’s U.S. citizenship, such as a passport, birth certificate, or naturalization certificate.
  • Proof of Continuous Presence: Collect evidence showing you have been continuously present in the United States for at least 10 years as of June 17, 2024. This could include rent receipts, utility bills, school records, hospital or medical records, or any official documentation confirming your presence in the U.S.

For non-citizen children, eligibility documentation may include:

  • Proof of relationship to the non-citizen parent, such as a birth certificate or adoption decree;
  • Evidence of the non-citizen parent’s marriage to a U.S. citizen;
  • Proof of the child’s presence in the United States as of June 17, 2024.
